1) ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

1.1 The contract stipulated between RODER SRL and the Customer must be considered concluded with the acceptance of the order by RODER SRL. By placing an order online, by telephone or by Fax or E-mail, the Customer declares to have read and fully accept the general conditions of sale and payment transcribed below.
1.2 The Customer must print or save an electronic copy and in any case retain these general conditions of sale.

2) PURCHASE METHODS

2.1 The Customer can purchase the products sold in the electronic catalogue on the website www.innovacheck.shop as described in the relevant technical information sheets or in communications via email. All the information to help with purchasing and present on the website are to be considered as simple generic information material, not referable to the real characteristics of a single product.
2.2 Receipt of the order is confirmed by RODER SRL by e-mail sent to the e-mail address provided by the Customer. This confirmation message will contain the order number or reference, order date, billing data and recipient of the goods, details and prices including VAT of the goods ordered, transport service and additional services, payment method, RODER SRL data, notes and warnings to the customer.
2.3 Once the order has been received from the Customer, RODER SRL staff will verify the payment, availability of the material, processing and acceptance of the same.
2.4 Any notice of non-acceptance of the order due to unavailability of the product and/or longer delivery times than those indicated in the product sheet, will be communicated promptly to the customer, by telephone or by e-mail. In such cases the Customer may change the product, wait for availability within the new times communicated or cancel the order requesting a refund for any sum already paid.
2.5 The Customer is excluded from any right to compensation for damages, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order.
2.6 Cancellations or changes to an order already submitted may be made by the customer within 24 hours of placing the order and must be sent in writing to RODER SRL via email. After this deadline (24 hours) cancellations or changes cannot be guaranteed and will be authorised by RODER SRL based on the progress of the order processing.
2.7 The images accompanying the technical data sheet of a product may not be perfectly representative of its characteristics.

3) DELIVERY TIMES

3.1 RODER SRL undertakes to make the delivery as soon as possible.
3.2 In each estimate and/or order confirmation, the average times for the production and delivery of the product are indicated and must not be considered binding by the Customer with respect to the conclusion of the contract stipulated with RODER SRL.
3.3 Any advances or delays in the delivery times indicated or provided by email or telephone that cannot be identified at the time of the order, but only during the preparation or production phases of the order, will be communicated promptly as soon as RODER SRL becomes aware of them. In any case, they cannot be considered by the customer for requests for compensation for damages or indemnity as well as any contractual or extra-contractual liability for direct or indirect damages to people and/or things.

4) SHIPPING AND DELIVERY

4.1 Purchases made on www.innovacheck.shop are delivered by national and international express couriers, to the delivery address indicated at the time of ordering. During the ordering process, it is possible to indicate a contact person and a delivery location different from the data provided for the order heading and invoicing.
4.2 For each order placed, RODER SRL issues a suitable accompanying document for the material shipped (Accompanying Invoice or Transport Document). For the issuance of such documents, the information provided by the Customer at the time of the order is valid. After the invoice has been issued, it will not be possible to make any changes to it.
4.3 Shipping costs are calculated based on the volume of the goods and the destination.
4.4 The Customer can communicate any detail that he/she deems necessary for the courier to reach the place of delivery, indicating it in the order notes or via an e-mail to info@roder.it before shipping the goods.
4.5 RODER SRL will inform the customer via email of the imminent shipment.
4.6 Standard delivery is made to street level.
4.7 Deliveries made to disadvantaged areas such as smaller islands, mountainous areas that are difficult to reach, pedestrian areas and/or areas with limited access to normal means of transport of goods and for which the customer has not previously informed RODER SRL may be subject to a price supplement which will be communicated to the customer by email as soon as possible and in any case before the shipment of the goods.
4.8 National and international couriers make deliveries from Monday to Friday, during normal working hours regulated and indicated by them and cannot be controlled by RODER SRL.
4.9 RODER SRL cannot be held responsible for delays in delivery attributable to the carrier in charge.
4.10 In the event of tampering and/or breakage of the packaging, the customer must accept the goods with “RESERVATION OF INSPECTION”, personally describing the damage in detail on all copies of the courier’s delivery receipts. Example: “Reservation of inspection of goods due to damaged packaging”. In the event of obvious damage to the products, the customer can directly refuse delivery, personally describing on all copies of the courier’s delivery receipts the reason for failure to collect. Example: “I will not collect the goods due to obvious damage to the packaging and internal products”.
4.11 At the time of delivery, the courier is required to wait only for the Customer to verify the integrity of the packages. The opening of the packages and the control of the integrity of the products contained therein must be carried out subsequently by the Customer. The original packages and any accessories must in any case be kept for the entire duration of the product warranty, so that they can be reused in the event of returns, defects or other.
4.12 Once the presence of damage caused by transport has been ascertained, the customer is required to report it to RODER SRL within 5 (five) days of receiving the goods by email, complete with photographic documentation of the packaging and the damaged goods.
4.13 The Customer who for any reason does not follow the above-mentioned instructions of this contract will not be able to subsequently claim from RODER SRL any shortages or damages caused by the transporter.

5) WARRANTY, RETURNS AND REPLACEMENT OF PRODUCTS

5.1 All products are guaranteed for the period indicated in our estimates and/or order confirmations starting from the date of our invoicing. The guarantee excludes any compensation for damages. RODER SRL has the right to decide whether to proceed with the repair or replacement of a product. The company does not accept returns or replacements. Each return must be previously authorised by RODER SRL. Otherwise it will be rejected. If the return is accepted by us as authorised, a cost will be applied (variable between 10% and 20% of the net price of the product based on the product, type, etc.) for its management, repackaging, integrity check, etc. In no case will we accept products that are not included in the price list, without the original packaging, worn, with signs of use or incomplete. Transport costs for returns are at the Customer's expense. These general conditions are valid and also applied for any product replacements due to an incorrect order, provided that they have been agreed and accepted by RODER SRL.

6) RIGHT OF WITHDRAWAL

6.1 In compliance with Legislative Decree 206/2005 (Consumer Code), the CONSUMER has the right to withdraw from the contract, without stating the reasons, within 14 days. A consumer or Customer is a natural person who purchases for purposes other than any professional/entrepreneurial/artisan activity carried out. THE RIGHT OF WITHDRAWAL DOES NOT APPLY in the case of purchases made for business and professional activities (sales with VAT invoicing). The withdrawal period ends 14 days after the consumer has acquired physical possession of the goods. To exercise the right of withdrawal, the consumer must inform RODER SRL of his decision by email to info@roder.it or by fax to 0124-470611. The costs for returning the goods (as well as the risks arising from transport) will be entirely borne by the Customer. 6.2 Effects of withdrawal: if you withdraw from the sales contract, all payments you have made to us will be refunded, including delivery costs if any, without delay. These refunds will be made using the same payment method you used for the initial transaction unless otherwise agreed. In any case, you will not bear any costs as a consequence of such refund. In the event of a valid and timely exercise of the right of withdrawal by the Customer, RODER SRL will refund the payment received to the former, without undue delay and in any case within 14 days from the moment in which it was informed of the exercise of the right of withdrawal by the Consumer Customer. The refund may be suspended until receipt of the goods or until the consumer has demonstrated that he has returned the goods, whichever is earlier.

6.3 Decrease in value and reasons for exclusion: the goods subject to a valid right of withdrawal exercised by the Consumer must be returned to RODER SRL in the same conditions in which the first had received them, complete with all elements, provided with the original packaging, any enclosed manuals and without the Consumer having used, consumed or damaged them. RODER SRL reserves the right not to accept the return of the products by the consumer if the same have been altered in their essential and qualitative characteristics, or if the same have been damaged. In such cases RODER SRL will provide and return the goods to the consumer, freight collect with shipping costs paid by the recipient.

8) UPDATES

8.1 In order to provide a constantly updated service, RODER SRL reserves the right to modify at any time and without prior notice the technical data, texts, drawings, descriptions, graphics, photographs, variants and colours, item availability, delivery times, general conditions of sale and any other part contained in the site www.innovacheck.shop and in all other partner sites.

9) COMPETENT COURT

For any controversy or dispute, in any way dependent on this contract, the Court of Turin shall have exclusive jurisdiction.
